CASE FACTS: America Batet brought suit for medical malpractice against Dr. Juan Sorondo and his professional association. She alleged that the serious neurological condition from which she suffered, tardive dyskinesia, had been caused by Dr. Sorondo’s misprescription of the drug Reglan. After a jury trial, a jury verdict was rendered in favor of the defendant physician and his professional association. The trial judge granted the plaintiff a new trial. The defendants appealed.
